Overview
The Zoning Board of Appeals is a quasi-judicial body that operates under the authority of Chapter 40A of the General Laws of the Commonwealth of Massachusetts for the purpose of promoting the health, safety, convenience, and general welfare of the inhabitants of the Town of Mt. Washington. Article IV of the Mt. Washington Zoning Bylaws also outlines the specific rules, regulations and responsibilities that must be followed for all ZBA decisions.

The ZBA holds public hearings and acts on applications for:

  1.  Appeals taken by any person aggrieved by reason of his (her) inability to obtain a permit or enforcement action from any administrative officer under the provisions of M.G.L.A 40A,
  2. Variances with respect to a particular land or structure from the terms of the Mt. Washington Zoning By-Laws, where the ZBA specifically finds that all conditions required for a variance have been met (Art. IV, Section 215-8, B, (1), (2), (3)).

Most ZBA hearings are for Variance applications for residential uses not allowed by right. All meetings and public hearings of the ZBA are open to the public. Hearings are advertised in the local paper and abutters are notified at least two weeks in advance of the hearing.

The ZBA does not grant Special Permits.  Special Permit applicants must seek approval from the Mt. Washington Planning Board.
